David Wasinger Named “Litigator of the Week”

A lot of bold-faced names on Wall Street and in Washington are playing a role in Bank of America’s reported $16 billion settlement with the Department of Justice, which may be right around the corner. Daming Successfully Defends Clients in Trial

August 11, 2014 On August 7, 2014, the Honorable Richard Bresnahan entered judgment in favor of Michael Daming’s clients following a bench trial in the Circuit Court for St. Louis County, who had been sued for compensatory and punitive damages stemming from an alleged breach of a non-competition agreement. Prior to Daming’s retention, a preliminary injunction had been entered against Daming’s clients, but the court dissolved the injunction and rejected all of Plaintiff’s claims.

Court of Appeals Affirms Judgment

June 25, 2014 On June 24, 2014, the Missouri Court of Appeals affirmed a judgment entered after a two-day trial in favor of one of Michael Daming’s business clients. The trial court entered judgment for the full amount sought at trial, which involved various contract and fraud allegations, and the Court of Appeals affirmed the judgment in its entirety in a per curiam order.

May 21, 2014 Michael Daming successfully obtained judgment in favor of his client TCR Enterprises, LLC in a commercial real estate dispute in St. Louis County. Judgment was entered on April 28, 2014 at the close of a contested bench trial for the full amount alleged at trial to have been due and owing.

Wasinger Settles Case for $614 Million

April 15, 2014 David Wasinger represented Keith Edwards in a qui tam whistleblower case filed on behalf of the United States of America against JP Morgan Chase. The bank paid $614 million to settle charges that it violated rules of the Federal Housing Administration and Department of Veteran Affairs. Wasinger worked with the U.S. Attorneys’ office in Southern District of New York. Mr. Edwards received $63.9 million as part of the settlement.

Court of Appeals Affirms $1.2 Million Judgment

August 27, 2013 The Missouri Court of Appeals affirms a $1.2 million judgment in favor of one of the firm’s banking clients. The case involved the validity of municipal ordinances requiring a local municipality to reimburse certain fees incurred in developing real estate. The Missouri Supreme Court has accepted an application to hear the case.
